1.Who we are
IntelliSphere Cloud ("IntelliSphere", "we", "us") is a technology services business based in Nairobi, Kenya. We design, build and operate software, commerce and point-of-sale systems, cloud infrastructure, networks and security for businesses.
These terms govern your use of intellisphere.cloud (the "website"). By using the website you agree to them. If you do not agree, please do not use the website.
2.Website use versus paid services
These terms cover the website only. Any project, support plan or other paid work is governed by a separate written proposal, quotation or service agreement signed by both parties. If that agreement conflicts with these terms, the agreement wins.
Nothing on the website is a binding offer. Service descriptions, timelines and examples show what we typically do; scope, price and delivery dates are only confirmed in writing for your project.
3.Enquiries, quotes and estimates
When you contact us through the website we will reply to discuss your needs. Quotations are valid for 30 days unless they say otherwise, and are based on the information you give us. If the scope changes, the quote may change too, and we will tell you before doing extra work.
4.Demos and examples
The website includes interactive demonstrations, such as the online shop and point-of-sale demo. They use sample products, names and transaction references. No real payment is taken, no real tax invoice is issued, and no payment or tax system is contacted.
5.Acceptable use
You agree not to:
- use our forms to send spam, malicious links or content you have no right to share;
- attempt to break, overload, scan or bypass the security of the website or its forms, including our spam protection;
- scrape the website in bulk or use it to train or build a competing service;
- impersonate another person or business, or give false contact details.
We may block access or ignore submissions that break these rules.
6.Intellectual property
The website's text, design, code, graphics, logo and articles belong to IntelliSphere Cloud or are used under licence. You may read, share links to and quote short extracts from our articles with credit and a link. You may not copy the website, its design or the IntelliSphere name and logo for your own use without written permission.
Ownership of work we create for clients is set out in each client's service agreement.
7.Third-party services and links
We use trusted service providers to host the website, deliver email and protect our forms from spam. We may link to other websites; we are not responsible for the content or practices of sites we do not control. Product and company names mentioned on the website belong to their owners and are used only to describe compatibility.
8.Accuracy of information
We write our articles and service pages carefully, but technology, regulations and prices change. Content is general information, not advice for your specific situation. Please speak to us, or another qualified professional, before acting on it.
9.Limitation of liability
The website is provided "as is". We do not promise that it will always be available or free of errors. To the extent allowed by Kenyan law, we are not liable for indirect or consequential losses, or for loss of profit, data or business, that arise from using the website, its demos or its content.
Nothing in these terms limits liability that cannot legally be limited, including for fraud, or for death or personal injury caused by negligence. Liability for paid services is governed by the relevant service agreement.
10.Privacy and cookies
How we handle personal data is explained in our Privacy policy. How we use cookies, and how to change your choice, is explained in our Cookie policy.
11.Governing law
These terms are governed by the laws of Kenya. Any dispute will first be discussed in good faith; if it cannot be resolved, the courts of Kenya sitting in Nairobi will have jurisdiction.
12.Changes to these terms
We may update these terms as the website or the law changes. The "last updated" date shows the current version. Continuing to use the website after a change means you accept the updated terms.
